Rehabilitating Lochner: Defending Individual Rights against Progressive Reform ReviewIn my constitutional law class, my understanding of Lochner was as follows: The Supreme Court essentially made up the right to liberty of contract around 1900, and used that right to subvert needed economic reform while ignoring the rights of minorities and others. Wise Justices like Holmes saw right through the majority, and revealed that they were simply trying to impose the Justices' anti-labor preferences on the country at large. Meanwhile, Holmes and his colleague Brandeis started to redirect the Fourteenth Amendment away from the protection of property and contract rights toward the protection of civil liberties. In the 1930s, the anti-Lochner forces won, and Holmes and Brandeis's Progressive vision came to dominate constitutional law.
The thrust of Rehabilitating Lochner is that all of this is conventional wisdom, yet it is wrong in almost every detail. It's a short, readable book, but manages to convey an incredible amount of information about the real story of Lochner, its supporters, its Progressive critics, and the continuing influence of Lochner on modern constitutional law. It's too rich to try to sum up in a short review, so just read it!Rehabilitating Lochner: Defending Individual Rights against Progressive Reform OverviewIn this timely reevaluation of an infamous Supreme Court decision, David E. Bernstein provides a compelling survey of the history and background of Lochner v. New York. This 1905 decision invalidated state laws limiting work hours and became the leading case contending that novel economic regulations were unconstitutional. Sure to be controversial, Rehabilitating Lochner argues that the decision was well grounded in precedent—and that modern constitutional jurisprudence owes at least as much to the limited-government ideas of Lochner proponents as to the more expansive vision of its Progressive opponents. Tracing the influence of this decision through subsequent battles over segregation laws, sex discrimination, civil liberties, and more, Rehabilitating Lochner argues not only that the court acted reasonably in Lochner, but that Lochner and like-minded cases have been widely misunderstood and unfairly maligned ever since. The Declaration of Independents: How Libertarian Politics Can Fix What's Wrong with America ReviewI'd say this is probably the most dangerous political book of the year--for the Republican and Democrat establishment. The Declaration of Independents is a call to Americans to get past our historic political tribalism, stop defending the two major parties simply because we might belong to one, and to pursue our own happiness without interference from government.
I decided to get this book because I'm a big fan of Reason.com and Reason Magazine, and Nick and Matt. This book appealed to me because, like many Americans, I got tired of the expansion of government under Bush and Obama, despite their promises to cut it. If you're a fan of Obama and the Democrats, please get this book. Same to fan of Bush and the Republicans. Nick and Matt's treatment of each party is entirely fair; you will never come away thinking, "Wow, that was a cheap shot." There were a couple things in the book I disagreed with, but their arguments were always well-reasoned and sincere.
I especially liked the case studies and historical examples of libertarianism in action. The review of rock n' roll and the fall of the Communists in Czechoslovakia was fantastic. So was the example of Southwest Airlines and how it overcame government regulation and government protectionism in favor of already-existing airline corporations.
I'd recommend this book to anyone interested in politics, whether you're Republican, Democrat, or Zulu. I wouldn't recommend this book to someone who just wants to read how great their party is and how awful the other party is--you're head will probably explode. I hope after reading this book, more people are willing to declare independence from their political allegiances in order to get at the truth and expand our personal freedoms.
The Declaration of Independents: How Libertarian Politics Can Fix What's Wrong with America OverviewEverywhere in America, the forces of digitization, innovation, and personalization are expanding our options and bettering the way we live. Everywhere, that is, except in our politics. There we are held hostage to an eighteenth century system, dominated by two political parties whose ever-more-polarized rhetorical positions mask a mutual interest in maintaining a stranglehold on power.
The Declaration of Independents is a compelling and extremely entertaining manifesto on behalf of a system better suited to the future--one structured by the essential libertarian principles of free minds and free markets. Gillespie and Welch profile libertarian innovators, identify the villains propping up the ancien regime, and take aim at do-something government policies that hurt most of those they claim to protect. Their vision will resonate with a wide swath of frustrated citizens and young voters, born after the Cold War's end, to whom old tribal allegiances, prejudices, and hang-ups abouteverything from hearing a foreign language on the street to gay marriage to drug use simply do not make sense.

Mobility First: A New Vision for Transportation in a Globally Competitive Twenty-first Century ReviewI enjoyed reading this book, as it gives a different perspective on urban transportation systems here in the United States. Solutions to many of the mobility issues facing US cities today, especially road congestion, are presented. The solutions preferred by the authors are very aggressive and non-traditional. Reading this book has strengthened my view that solutions to our transportation issues are an important piece to keeping the United States economy strong globally.
I found the chapter on New York City to be especially interesting. It broadened my perspective on the relationship between different modes of transportation in our nation's largest and most complex city.Mobility First: A New Vision for Transportation in a Globally Competitive Twenty-first Century OverviewTraffic congestion is a growing problem and unless policy makers and transportation officials make some dramatic changes, it will rise to unacceptable levels by 2030.
